I hereby authorize the above repair work to be done along with the necessary material, and hereby grant you and/or your employees permission to operate the motorcycle herein described on streets, highways or elsewhere for the purpose of testing and/or inspection. An expressed mechanic's lien is hereby acknowledged on above motorcycle to secure the amount of repairs there to.

Labor Rate $120


NOTICE - A Storage fee of $25.00 per day will be charged if the motorcycle is in shop (10) ten days after completion.

Whereas, Howling Moto is offering storage for motorcycles and ATVs, and in exchange for valuable consideration, the owner of said vehicle desires to hold harmless Howling Moto from any claims and/or litigation arising out of Howling Moto’s performance of storage of these vehicles, now therefore, in consideration of the mutual covenants and conditions contained herein, the owner of said vehicle and Howling Moto hereby agree as follows:

Terms

Hold Harmless. The owner of said vehicle shall fully defend, indemnify, and hold harmless Howling Moto from any and all claims, lawsuits, demands, causes of action, liability, loss, damage and/or injury, of any kind whatsoever (including without limitation all claims for monetary loss, property damage equitable relief, personal injury and/or wrongful death), whether brought by an individual or other entity, or imposed by a court of law or by administrative action of any federal, state, or local governmental body or agency, arising out of, in any way whatsoever, any acts, omissions, negligence, or willful misconduct on the part of Howling Moto, its officers, owners, personnel, employees, agents, contractors, invitees, or volunteers. This indemnification applies to and includes, without limitation, the payment of all penalties, fines, judgments, awards, decrees, attorney’s fees, and related costs or expanses, and any reimbursements to Howling Moto for all legal fees, expenses, and costs incurred by it. Authority to Enter Agreement. Each party warrants that the individuals who have signed this agreement have the actual legal power, right, and authority to make this Agreement and bind each respective Party. Amendment Modification. No supplement, modification, or amendment of this agreement shall be binding unless executed in writing and signed by both parties

Waiver. No waiver of any default shall constitute a waiver of any other default or breach, whether of the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily given or performed by a Party shall give the other Party any contractual right by custom, estoppel, or otherwise. Entire Agreement. This Agreement contains the entire agreement between the Parties related to the matters specified herein, and supersedes any prior oral or written statement or agreements between the Parties related to such matters. Enforceability, Severability, and Reformation. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. Requirement of Insurance. The owner, or representative of the owner, understands that Howling Moto does not take custody and control of the vehicle while it is parked in the storage area and/or building. Storage of the vehicle does not create a duty of care under Illinois law. The owner assumes all risk of loss that may occur as a result of theft, vandalism, fire, flood, or other risks of storage of a vehicle. To the extent that damage occurs, the owner understands that Howling Moto does not provide full insurance coverage, that all losses due to risks of storage are not to be covered. The owner agrees that he or she will maintain adequate insurance on his or her stored vehicle to cover potential loss.
